My mediation was conducted online. As the dispute remains unresolved, the mediator is arranging for an in-person session. Can I refuse to attend the session and request for mediation to continue virtually?

Last updated 14 Aug 2023

No. You will be required to attend the in-person mediation session if the mediator has assessed that it is more effective to resolve the dispute in-person.

If you do not attend the mediation session, the claimant can request for the dispute to be referred to the Employment Claims Tribunals (ECT) for a decision.
